建筑工程消防設(shè)計備案辦事指南 一、受理范圍 1.依法應(yīng)當(dāng)辦理施工許可證， 不需要消防行政許可， 按照國家建設(shè)工程消防技術(shù)標(biāo)準(zhǔn)需 要進(jìn)行消防設(shè)計的建設(shè)工程，有新建、擴建、改建 (含改造、室內(nèi)外裝修、建筑保溫、用途 變更 )等活動的，都應(yīng)該納入消防備案監(jiān)管范圍。建設(shè)工程消防備案不適用住宅內(nèi)裝修、村 民自建住宅、救災(zāi)和其他非人員密集常場所的臨時性建筑的管理。 根據(jù)《建設(shè)工程消防監(jiān)督管理規(guī)定》和《建筑工程施工許可管理辦法》 (建設(shè)部令第 71 號)及云南省政府規(guī)定，以下建設(shè)工程可以不申請辦理施工許可證，可以不進(jìn)行消防設(shè)計、 竣工驗收消防備案 :(1) 工程投資額在 100萬元以下的建設(shè)工程 ;(2) 建筑面積在 1000 ㎡以下 的建設(shè)工程。其中對工程規(guī)模的判斷，應(yīng)以《建設(shè)工程規(guī)劃許可證》或相關(guān)職能部門批準(zhǔn)文 件內(nèi)容為準(zhǔn)。 禁止將應(yīng)當(dāng)實施行政許可的建設(shè)工程項目拆分或變相拆分為幾個項目實施建設(shè)工程消
